1. Acceptance of Terms
Welcome to NotaryHub ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the NotaryHub website, mobile applications, and related services (collectively, the "Platform"), operated by NotaryHub, a Texas-based technology company.
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Platform and Services
NotaryHub operates an online marketplace and directory that connects consumers and businesses ("Customers") seeking notary public services with commissioned notaries public ("Notaries" or "Notary Partners") in the State of Texas.
The Platform provides:
- A searchable directory of commissioned notary public professionals in Texas
- Profile listings and business pages for Notaries to advertise their services
- Tools to facilitate booking requests and communications between Customers and Notaries
- Subscription-based premium listing features for Notary Partners
- Educational resources and content related to notary services
Important Disclaimer: NotaryHub is a technology platform only. We do not employ Notaries, provide notary services, or offer legal advice. We are not a law firm, and no attorney-client relationship is created by your use of the Platform.
3. Eligibility and User Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By creating an account, you represent and warrant that:
- All information you provide is accurate, current, and complete
- You will maintain the accuracy of your account information and update it as needed
- You will safeguard your password and accept full responsibility for all activities that occur under your account
- You will notify us immediately of any unauthorized use of your account
- You will not create accounts by automated means or under false pretenses
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
4. For Notary Partners
If you register as a Notary Partner on the Platform, the following additional terms apply:
- You must hold a valid notary public commission in good standing from the State of Texas
- You are solely responsible for maintaining your commission, bond, errors and omissions insurance, and compliance with all applicable Texas notary laws and regulations, including the Texas Government Code Chapter 406
- You must accurately represent your qualifications, services, pricing, availability, and geographic service area
- You are an independent contractor and not an employee, agent, or partner of NotaryHub
- You are solely responsible for the notarial acts and services you perform for Customers
- You agree that any disputes between you and a Customer regarding services, fees, or quality are between you and the Customer
- You grant NotaryHub a non-exclusive, royalty-free license to display your profile content and business information on the Platform and in marketing materials
Verification: We may request documentation to verify your notary commission or other credentials. Failure to provide requested documentation may result in removal of verification badges or suspension of your account.
5. For Customers
If you use the Platform to find or request notary services, the following terms apply:
- You are responsible for verifying the Notary's current commission status and qualifications before engaging their services
- You agree to provide accurate and truthful information when submitting booking requests or inquiries
- You understand that NotaryHub does not guarantee the quality, availability, or pricing of any Notary's services
- You are responsible for paying any fees charged by the Notary for services rendered
- You agree to comply with all requirements for notarization, including bringing valid identification and any necessary witnesses
No Guarantee: NotaryHub does not endorse, recommend, or guarantee any Notary listed on the Platform. Customer reviews and ratings reflect the opinions of individual users and not those of NotaryHub.
6. Fees, Payments, and Subscriptions
Customer Fees: NotaryHub does not charge Customers for using the directory or submitting booking requests. All fees for notary services are agreed upon directly between the Customer and the Notary.
Notary Subscriptions: NotaryHub offers optional subscription plans to Notary Partners for enhanced profile features, priority placement, and lead generation tools. Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis until cancellation.
- Subscriptions automatically renew unless cancelled before the renewal date
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- We do not provide refunds for partial billing periods except as required by law
- We reserve the right to change subscription fees upon notice to subscribers
All payment processing is handled by secure third-party providers such as Stripe. We do not store complete credit card information on our servers.
7. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Platform for any illegal purpose or in violation of any local, state, or federal law
- Impersonating any person or entity, or misrepresenting your identity, credentials, or affiliations
- Submitting false, misleading, or fraudulent information
- Attempting to gain unauthorized access to the Platform, user accounts, or connected systems
- Interfering with or disrupting the Platform, servers, or networks
- Scraping, harvesting, or extracting data from the Platform without written permission
- Posting defamatory, obscene, harassing, or discriminatory content or reviews
- Using the Platform to solicit or perform illegal notarial acts, including unauthorized practice of law
- Circumventing our fee structure by soliciting off-platform transactions discovered through NotaryHub
8. Content and Intellectual Property
Platform Content: All content on the Platform, including text, graphics, logos, software, and trademarks, is the property of NotaryHub or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
User Content: You retain ownership of any content you submit to the Platform, including profile information, reviews, and messages. By submitting content, you grant NotaryHub a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform.
You represent that you have all necessary rights to any content you submit and that your content does not violate the rights of any third party. We reserve the right to remove any content that violates these Terms or that we determine to be objectionable.
9. Disclaimers
THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NOTARYHUB DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content or information provided by Notaries or other users.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOTARYHUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO NOTARYHUB IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) $100.
These limitations apply even if NotaryHub has been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless NotaryHub and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Platform
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your conduct in connection with notary services arranged through the Platform
12. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all licenses and other rights granted to you under these Terms will immediately cease.
Sections that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Platform shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved exclusively through binding arbitration in Houston, Texas, in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
